Terms & Conditions
Extreme Element Ltd is an agent for selected extreme sports courses & experiences
across the UK & Abroad that appear on this website. When you purchase or
activate a voucher or buy a course or experience from Extreme Element Ltd you
become legally bound by these terms and conditions. Please do not proceed and
purchase or activate a voucher or complete a booking until you have read, understood
and accepted these terms and conditions.
1. Prices
The prices displayed on our website are correct to the best of our knowledge
and maintained on a daily basis. In the event of an order being placed against
an accidental incorrect price, we will endeavor to inform the purchaser of the
error within 7 days of the purchase being made, we will allow the purchaser
to either cancel the booking or choose to pay the additional difference in price.
Prices of courses and experiences may vary throughout the year. If a voucher
has been bought for a course or experience and the price has increased then
the customer must pay the balance, if the price has decreased then the remaining
balance will be stored as credit on their online account.
2. Duration
Where the duration of a course or experience is mentioned on our website and
marketing material or by a member of our staff this is an approximate guide
to the length of time you should expect to be at the venue. The duration may
vary slightly from venue to venue. When you are taking the course or experience
as part of a group there may be some waiting time involved.
3. Descriptions & Images
All descriptions contained on our website and in our marketing material are
correct at the time of going to press. Descriptions may be updated throughout
the year as courses & experiences change. The images used in all promotional
literature to illustrate courses & experiences, particularly those that
take place at more than one location, are used as an indication only. If on
contacting the partner centre you feel that the activity taking place no longer
accurately represents the activity purchased, Extreme Element Ltd will exchange
the voucher or refund the purchase price.
4. Availability
All experiences & courses are offered subject to the availability
of dates, vehicles, facilities and staff. Bookings should be made at
least 3 weeks in advance. If you would like to book during peak times
(such as weekends or holidays), you should book further in advance.
Bookings are not finalised until you have received written confirmation
from us. We suggest if you plan to purchase an Ex Pass for a date at
short notice, you call us to ensure there is still availability before
completing the transaction. You should not make any arrangements in
connection with the course / experience until you have received your
booking confirmation.
Where specific elements of the course / experience such as vehicles are not
available due to mechanical breakdown, we reserve the right to make reasonable
substitutions on the day. If this is not possible we reserve the right to cancel
the course / experience at short notice.
5. Restrictions
Certain courses & experiences provided by suppliers are subject to minimum
age, health or other requirements. These details are listed on our website and
at the time of booking. Please read this information carefully once you have
received it and notify us within seven days if any service is unsuitable. Once
you have confirmed a booking you may be liable for supplier and/or agency charges
if you are forced to cancel because the minimum requirements are not met. Details
of each supplier's requirements are set out on our website under each service.

6. Weather
Many experiences & courses we offer are weather dependent. You will have
the venue's details and we strongly advise that you call to confirm if adverse
weather has been forecast on the morning of your experience. For example, certain
courses & experiences we offer may not be able to run at all if there is
too little wind, too much wind or if it is the wrong direction so please check
with the venue first. If bad weather affects a booking it will be rescheduled
at no cost to you. There can be no guarantee that a particular date will not
be withdrawn due to extreme adverse weather conditions.
7. Safety
We ask you to leave plenty of time to get to the venue. Many of the
courses and experiences we offer require a safety briefing it is essential
that the participant attends the briefing otherwise they will not be
able to participate. No alcohol or drugs can be consumed before any
of the courses or experiences we offer. The staff at the venue reserve
the right to refuse an activity to persons suspected to be under the
influence of alcohol and / or drugs.
Where the experience requires the wearing of safety equipment such as a crash
helmet or a lifejacket this is mandatory and there are no exceptions. Other
safety precautions will be advised in your confirmation details. Each venue
employs professional instructors who reserve the right to end an experience
or course or offer alternative tuition if they believe the participant may endanger
themselves or other members of the public.
8. Partner Centres & Liability
Although Extreme Element Ltd has sought to select highly experienced
partner centres offering courses & experiences, Extreme Element Ltd
shall not be responsible for the safety standards or the quality or
delivery of the course or experience, or any loss or damage suffered
by you whilst participating in the course or experience for which the
partner centre shall be solely responsible.
By purchasing or redeeming a voucher, you acknowledge that the course or experience
is dependent on certain factors beyond the control of Extreme Element Ltd and
agree that neither Extreme Element Ltd nor any associated partner centre shall
be liable for the cancellation, postponement or alteration of any course or
experience for reasons beyond its reasonable control including for weather-related
reasons, mechanical failure or otherwise. We do not undertake any technical
examination of equipment, facilities or services in order to minimise personal
risk. If it occurs that mechanical machinery breaks down you should expect reasonable
substitutions without notice. The total liability of Extreme Element Ltd for
any claim whatsoever in connection with the course or experience voucher or
any course or experience shall be limited to the price paid for the voucher.
Extreme Element Ltd suppliers are located at destinations across the UK &
abroad. We are continually adding locations but occasionally we may need to
stop featuring some centres.
9. Refunds and Cancellations
Sometimes we have to cancel a course/experience for reasons beyond
our control, such as the weather or mechanical breakdown. We will do our best
to notify you as soon as possible and do everything we can to offer you an alternative
date or time. We regret that, in these circumstances, Extreme Element Ltd is
unable to reimburse travel, accommodation or any other expenses you may incur
in relation to the cancelled experience.
A course or experience may be terminated without warning during the lifetime
of the voucher - on these occasions an equivalent course or experience in the
general geographical area will be substituted. If this is deemed to be too far
by the customer then credit will be offered but no cash refunds will be made.
a) Vouchers & Physical Goods (within 28 days of purchase)
You have the right to return any goods within 28 days of receipt and any vouchers
within 28 days of purchase and a refund will be paid. All refunds will incur
a £20 or 20% (whichever is greater) administration charge. All refunds
will be made to the person who purchased the voucher / goods and the monies
will be refunded directly to that debit / credit card.
b) Vouchers (after 28 days of purchase)
No refunds will be made on vouchers more than 28 days after the date of purchase.
However the voucher is still free to be activated online (if within 10 months
of the purchase date) and the credit can be used against any of our entire product
range.
c) Activated Vouchers
Once a voucher has been activated online no refund can be made.
d) Bookings (when an specific date is confirmed)
Should you need to re-schedule or cancel a booking you have already made, we
will always do our best to help. No refunds will be made on bookings cancelled
within 30 days of the course or experience date. We require cancellations or
re-scheduling to be confirmed at least 30 days before the course or experience
date and we will notify you of any variations to this cancellation period at
point of booking. As policies do vary from venue to venue, please note that
cancellation or re-scheduling may not always be possible. If a booking is postponed
for any reason a new date will be arranged at the same location, no refund is
possible in this situation. All refunds on bookings will incur a £20 or
20% (whichever is greater) administration charge. All refunds will be made to
the person who has made the booking and the monies will be refunded directly
to that debit / credit card. If you have received a voucher and booked your
course or experience directly with a partner centre you are bound by their terms
and conditions (please make yourself aware of these at the time of booking).
10. Complaints
If a problem is encountered please bring it to the attention of the manager
or activity co-ordinator, enabling them the chance to resolve the issue. If
no action is taken we deem this to be unsatisfactory and please contact Extreme
Element Ltd office at the earliest point giving all the facts from your point
of view. A letter may be suggested at a later date.
11. Vailidity & Extensions
Each voucher will show a unique code, which must be quoted when dealing with
Extreme Element Ltd and which will be used to identify your order & payment
online. Vouchers and the associated references must be kept safely and securely.
Extreme Element Ltd will take no responsibility for any loss you may incur as
a result of impersonation or identity fraud. Each voucher is valid for a maximum
of 10 months from the date of dispatch unless otherwise stated. A voucher will
be deemed to be invalid if it is out of date (the validity date is clearly stated
on the voucher, booking information & your online account). If the customer
or recipient is unable to book and take the
course or experience before the expiry date, then upon the customer contacting
Extreme Element Ltd prior to the expiry date on the voucher
and paying an administration fee of £20 Extreme Element Ltd shall extend
the validiity of the voucher for another 10 months (from the date of the initial
expiration). A voucher can only be extended for another 10 months once. Once
a voucher has been extended it can not be refunded. Vouchers can only be extended
if they are still inside their expiry date. Extreme Element Ltd strongly
recommend that all experiences are booked as early as possible to avoid dissapointment.
12. Delivery
Your personalised Ex Pass (Voucher) or Ex Pack (Gift Pack) will be
sent in plain packaging from our offices in Central Brighton. We can provide
you with the Recorded & Special delivery tracking code to contact Royal
Mail in the event you need to locate the whereabouts of your delivery. We accept
no responsibility for Royal Mail Post service. Delivery charges are non-refundable.

are sent on the chosen dispatch date. Please call us for information on delivery
overseas.
We can send the Ex Pass (Voucher) or Ex Pack (Gift Pack) directly to
the recipient, or to another address at your request. If your Ex Pass
goes astray in the post we will provide a duplicate free of charge.
Please inform us as soon as possible if you believe this has happened
so we can do our best to deliver the duplicate pack in time.
Extreme Element Ltd vouchers can be delivered by email to the email address
entered by the purchaser. Some email accounts (especially work email and Hotmail
accounts) may categorise our email vouchers as unwanted or 'spam' email. To
avoid this please add our email address info@exelement.co.uk to your address
book. Extreme Element Ltd is not liable or responsible for any loss suffered
as a result of an email voucher being blocked by web filters or firewalls. If
the recipient does not receive the email voucher, please contact our dedicated
team immediately to send vouchers to an alternative email address. Alternatively,
we can change the delivery method which would incur the normal delivery fee
of that service.
13. Exchanges
Vouchers can be exchanged free of charge at any time. Each voucher
whether for a specific course / experience, a 'star' amount or a set monetary
value can be exchanged for any other course or experience at anytime for free.
If the substituted course or experience costs more than the original voucher
you must pay the difference, if the substituted course or experience is less
than the original voucher the remainding credit will be kept on the recipients
'My Ex Element' account valid for 10 months from the original voucher dispatch
date, after which time these funds will no longer be available to spend.
14. Insurance
The very nature of some of the services that we promote as agent means that
they are dangerous. Prior to ordering or participating in any service you should
be aware of the risks involved. Extreme Element Ltd can provide further information
if you are in any doubt about any service. We require our partner centres to
hold appropriate and valid public liability insurance before we will promote
their services as an agent and we make no warranty or representation about their
services whatsoever. Responsibility rests with you to make independent enquiries
with the supplier and other third parties as to the need to acquire your own
insurance cover.
15. Discount Codes
Discount codes are issued subject to availability and can be withdrawn without
notice at any time. Extreme Element Ltd reserve the right to stop discount codes
being used against specific products. Only one discount code can be used per
order. Discount codes apply to internet orders only.
16. Spectators
Most partner centres will allow you to bring spectators to watch you participate
in your selected course or experience. When booking your date please inform
the staff you wish to bring other people. Some partner centres may request a
small payment for spectators. Spectators are required to comply with the partner
centres terms, conditions and expectations of conduct. Any spectators deemed
under the influence or drugs or alcohol will not be permitted on site.
17. Bookings
All vouchers must be activated online at exelement.co.uk or by phone or email
with Extreme Element Ltd booking staff. Please do not arrive at a venue expecting
to redeem your gift voucher without first 'activating' your voucher with Extreme
Element Ltd. Extreme Element Ltd will not be held liable for your costs incurred
if you do not follow the procedure set out in these Terms and Conditions and
in your voucher pack.
